Terms of Service

These Terms govern your access to and use of the AndiIndia inference Services. Please read them carefully.

1. Agreement to these Terms

These Terms of Service ("Terms") form a binding agreement between you ("you" or "Customer") and AndiIndia ("AndiIndia", "we", "us", or "our") and govern your access to and use of our AI inference services, APIs, models, and related documentation (collectively, the "Services").

By accessing or using the Services, including by routing requests to our models through a third-party marketplace, you agree to be bound by these Terms. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Definitions

  • 'Models' means the machine-learning models we make available through the Services, including open-weight models we host.
  • 'Inputs' means the prompts, messages, and parameters you submit to the Services.
  • 'Outputs' means the content generated by a Model in response to Inputs.
  • 'Marketplace' means a third-party AI routing platform (such as OpenRouter) through which our Models are made available.

3. The Services

We provide OpenAI-compatible inference for open-weight Models served on GPU-backed infrastructure. Our Models are distributed through one or more Marketplaces rather than sold directly from this Site; access, authentication, and billing are handled by the applicable Marketplace under its own terms.

We may add, modify, deprecate, or discontinue Models or features, and we will use commercially reasonable efforts to communicate material changes that affect availability.

4. Eligibility and credentials

You must be capable of forming a binding contract and must use the Services in compliance with all applicable laws. You are responsible for safeguarding any credentials used to access the Services, for all activity conducted through them, and for promptly notifying the relevant party of any unauthorised use.

5. Acceptable use

You agree not to use the Services to:

  • Violate any applicable law or regulation, or infringe the intellectual property, privacy, or other rights of any third party.
  • Generate, distribute, or facilitate unlawful content, including content that sexually exploits or endangers minors.
  • Create malware, conduct phishing, or engage in fraud, spam, or deceptive activity.
  • Generate content intended to harass, threaten, defame, or unlawfully discriminate against others.
  • Attempt to disrupt, overload, probe, reverse engineer, or gain unauthorised access to the Services or underlying infrastructure, or circumvent rate limits or security controls.
  • Use Outputs for fully automated decisions with legal or similarly significant effects on individuals without appropriate human oversight.
  • Misrepresent Outputs as human-generated where doing so is deceptive or unlawful.

6. Rate limiting and fair use

To protect platform stability, requests are subject to rate, concurrency, and capacity limits. Exceeding a limit may result in throttling or an HTTP 429 response; clients should back off and retry with exponential delay. Limits may vary by Model, plan, and current capacity, and may be adjusted to preserve service quality.

7. Abuse handling, suspension, and termination

We monitor for abuse, fraud, and security threats. Where we detect a violation of these Terms or activity that threatens the platform, other users, or third parties, we may throttle, suspend, or terminate access, and where appropriate cooperate with the relevant Marketplace or lawful authorities. We aim to act proportionately and, where permitted, to notify affected Customers.

8. Fees and payment

Pricing for inference is published through the applicable Marketplace and in our /models endpoint. Billing, collection, and payment are administered by the Marketplace under its terms. You are responsible for all charges incurred through your use of the Services.

9. Model licenses and intellectual property

Open-weight Models are subject to their respective upstream licenses and acceptable-use policies (for example, the Gemma Terms of Use for Gemma models). Your use of a Model and its Outputs must comply with those licenses. As between you and us, we and our licensors retain all rights in the Services, software, and documentation; no rights are granted except as expressly set out in these Terms.

10. Customer content and outputs

As between you and us, you retain all rights in your Inputs, and, to the extent permitted by applicable Model licenses and law, in the Outputs generated for you. You are responsible for your Inputs and for your use of Outputs.

Outputs are generated probabilistically and may be inaccurate, incomplete, or offensive, and may not be unique to you. You should not rely on Outputs as a sole source of truth and should apply independent review for any high-stakes use.

11. Service availability and support

The Services are provided on a commercially reasonable, as-available basis. Unless a separate written service-level agreement applies, we do not guarantee any specific uptime, latency, or throughput. We may perform maintenance and deploy updates that temporarily affect availability. A public health endpoint exposes current status.

12. Third-party services

The Services are accessed through, and interoperate with, third-party platforms including Marketplaces and infrastructure providers. We are not responsible for the acts, omissions, terms, or availability of third-party services, and your use of them is governed by their respective terms.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Services and Outputs are provided 'as is' and 'as available', without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that Outputs will meet your requirements.

14. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, arising out of or relating to the Services, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the total amounts attributable to your use of the Services in the three (3) months preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100).

15. Indemnification

You agree to defend, indemnify, and hold harmless AndiIndia and its affiliates, officers, and personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your Inputs, your Outputs, or your use of the Services in violation of these Terms or applicable law.

16. Term and termination

These Terms apply while you access or use the Services. We may suspend or terminate access as described in Section 7 or where required by law. Provisions that by their nature should survive termination (including Sections 9, 10, 13, 14, 15, and 17) will survive.

17. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to applicable law, the courts located in India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to that jurisdiction and venue.

18. Changes to these Terms

We may update these Terms as the Services evolve. Material changes will be reflected by updating the 'Last updated' date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

19. Miscellaneous

These Terms, together with any policies referenced in them, constitute the entire agreement between you and us regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for failure or delay caused by events beyond its reasonable control.
